Censorship of Hip Hop Music

Many black business owners in the Baltimore area are expressing concern about some of the limits established in a recent ruling by the three members of Baltimore's Liquor Board when they approved a liquor license for Ray Charles Lounge. After a contentious two day hearing, the decision reached by the Liquor Board prevents Ray Charles Lounge from playing new hip hop music, as was requested in a Memorandum of Understanding (MOU) submitted by the Cedemont Community Improvement Association (CCIA), a largely white group.

In addition to banning music that is traditionally classified as hip hop, the ruling also mandates that other styles of music that the CCIA feels are closely related to new hip hop music, such as r and b music, reggae, and disco, are also forbidden. The attempts of Ray and April Charles to negotiate a compromise with the members of the CCIA proved unsuccessful when the community association expressed no interest in negotiating directly with them or with the assistance Councilman Brandon Scott.

The Charles' attorney Melvin Kodenski expressed concern about the unfair precedent set by asking black business owners to comply with the wishes of predominantly white community associations that do not typically use the businesses they are seeking to regulate, especially considering the fact that Baltimore is a majority black city. Many members of the black community are also wondering how the Liquor Board can justify requiring black businesses to not only meet the requirements of state and local laws governing liquor licenses, but also accommodate the musical whims of non-representative community associations to limit hip hop and r and b music, an imposition that many feel is unconstitutional.

To make matters worse, a Delegate to the Maryland General Assembly has written a bill, HB392, that would require the Baltimore Liquor Board to defer to MOU's from local community associations before issuing liquor licenses. This effort, combined with the recent ruling in the Charles' case, has created a very toxic environment for members of the black business community seeking to balance the needs of their black patrons against the demands of white community associations.
