What copyright guidelines do I need to be aware of when I create my products?
Intellectual property laws are complex, and often confusing. Below are some basic guidelines:
Copyright Protection Law: In general, you may publish only work that you created from original elements. This means you can’t use images of celebrities or corporate products. You can’t use images, text, or design that you cut from a Web site or any other published source without written authorization. You can’t create a “new” image that incorporates elements from images created by others, and you can’t use a quote or a slogan that is substantially the same as something already written by someone else.
Trademark Protection Law: Letters, words, designs, logos, and combinations of these can be trademarks for promoting the sale and distribution of goods and/or services. Trademarks identify and distinguish one seller’s goods and/or services from the goods and/or services of others. The test for infringement is whether your use of a design creates a likelihood of confusion on the part of the public. You cannot create products with a design that is likely to cause confusion.
